Right To Information Act, 2005 ( RTI)
Right To Information Act, 2005(RTI) is an important act for Indians. Its appeals to all of India except the state of Jammu and Kashmir. The RTI Act is 22 pages long and is comprised of 31 sections. It was the 22nd act passed in 2005. This act allows citizens to secure access to information under the control of public authorities. It was passed to promote the transparency and accountability of all public authorities. The constitution of Central Information Commission and the State Information Commissions.
This act pertains to international material in any format. A citizen able to obtain records, documents, memos, e-mails, opinions, advices, press releases, circulars, orders, orders, logbooks, reports papers, electronic material.
Citizens can apply for Suo-Motu (self declaration of any government institutions) under the section 4(1) (b). It has 17 points which includes functions and duties of organization, powers of officers, procedures and accountability rules regulation, agreements, statements of boards committees of officers and employees, the monthly remunerations, budget allocation, subsidy programs, recipients and permits of organization, details respect of the information, facilities available to citizens to obtaining information, names and designations of officers, and such other information as may be prescribed. This Suo-Motu information is free of cost.
If a citizen wants specific information from any government office he can obtain it under section 6(1) of the Right to Information Act 2005. When appealing attach one must 10rs postal order along with application. If one wants the information in hard copy one should include 2rs per copy. If one attaches a photocopy of his or her BPL card the information will be free of cost. Under this act a person should be receive the information within 30 days. If not then the citizen may file a against the government office. If the citizen does not an application or a sufficient response then he has the right to complain to a higher authority.
If the information requested is related to any religion, Indian security or military or is the personal information of an individual the authority has the right to reject application under the section 18(1).
In the application the citizen should write his name, address and phone number. The information requested should also be specified.
If no information is within 30 days or the application is rejected without due cause a citizen may file a complaint with the higher authority.
